ATTORNEY ADVISER (LABOR)

About the Position: This is an Attorney Adviser (Labor), GS-0905-14 position with the U.S. Army Corps of Engineers, Southwestern Division (SWD), Fort Worth District. The location is Fort Worth, TX. Provides oral and written advice to the Command, senior leaders, and other management officials on all aspects of federal employment and labor relations law. Advises the Command regarding the effect on management stemming from changes in employment laws and regulations, and the verdicts and settlements of grievances, EEO complaints, MSPB appeals, and Whistleblower Protection Act proceedings. Represents the District in administrative hearings before mediators, arbitrators, investigators, and administrative judges from various agencies. Develops the command position on litigation issues that arise in conjunction with federal court and administrative tribunal proceedings. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student; social). You will receive credit for all qualifying experience, including volunteer experience. Your resume must clearly describe your relevant experience; if qualifying based on education, your transcripts will be required as part of your application. The following minimum qualification requirements must be met before applicants are eligible for further consideration: Education: An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LL.B. or J.D.). Law school transcripts must be submitted at the time of application. Bar Membership: An applicant must currently be a member in good standing of the bar of a state, territory, or commonwealth of the United States, District of Columbia, or Commonwealth of Puerto Rico. Experience: An applicant must have more than three years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Fitness to Practice Law: An applicant must currently be fit to practice law. If your fitness to practice law, or your conduct has ever been challenged you must submit a sworn statement giving the facts and circumstances, together with any explanations you consider appropriate. The sworn statement should be notarized and dated within 3 months of the date of your application. (If you are currently employed as an attorney with The U.S. Army Corps of Engineers, this requirement does not apply to you). Time in Grade Requirement: If currently employed as an attorney by the Federal Government you must have completed one year at the next lower grade level within 30 days of the closing date of the announcement, or previously served at the same or higher grade as the position being filled. Knowledge, Skills, Abilities (KSAs) Qualification Requirements: 1. Specialized knowledge, skills and ability regarding labor and employment issues and in providing legal advice and trial advocacy as the Agency Representative before the Merit Systems Protection Board (MSPB), the Federal Labor Relations Agency (FLRA), the Equal Employment Opportunity Commission (EEOC), and other administrative tribunals, and providing support to DOJ when they are the attorney of record in court cases. 2. Knowledge, skills and ability to lead the organization's labor and employment legal services delivery including oversight and quality assurance and managing, mentoring, training, and motivating legal office staff and paraprofessionals, and developing and utilizing innovative approaches in solving labor and employment-related problems and issues. 3. Knowledge, skills and ability to function effectively as a senior counselor and advisor to the Command, senior leaders, and other management officials within the Corps of Engineers (and Fort Worth District) on federal labor and employment matters, disciplinary actions, performance management, labor relations matters, and equal employment opportunity policies and issues. 4. Knowledge, skills and ability with respect to areas of law such as federal authorities, fiscal law, and federal contract law. 5. Ability to communicate effectively, both orally and in writing.
